4、ProvisionsChapterIGeneralProvisionsArticle 1 Inordertoregulateexit/entryadministration,safeguardthesovereignty,securityandsocialorderofthePeople,sRepublicofChina,andpromoteforeignexchangesandopeningtotheoutsideworld,thisLawisherebyformulated.Article 2 ThisLawisapplicabletotheadministrationofexitande

5、ntryofChinesecitizens,entryandexitofforeigners,stayandresidenceofforeignersinChina,andtheexit/entryborderinspectionoftransportvehicles.Article 3 TheStateprotectsChinesecitizens,legitimaterightsandinterestsofexitingandenteringthecountry.ThelegitimaterightsandinterestsofforeignersinChinashallbeprotect

6、edbylaws.ForeignersinChinashallabidebytheChineselaws,andshallnotendangerChina*snationalsecurity,harmpublicinterestsanddisruptsocialandpublicorder.Article 4 TheMinistryofPublicSecurityandtheMinistryofForeignAffairsshall,withinthescopeoftheirrespectiveresponsibilities,beresponsibleforadministeringeite

7、ntryaffairs.EmbassiesandconsulatesofthePeople*sRepublicofChinaandotherinstitutionsstationedabroadentrustedbytheMinistryofForeignAffairs(hereinafterreferredtoas,thevisa-issuingauthoritiesabroad,)shallberesponsibleforissuanceofentryvisastoforeigners.Exit/entryborderinspectionauthoritiesshallberesponsi

8、bleforcarryingoutexit/entryborderinspection.Publicsecurityorgansunderlocalpeople*sgovernmentsatorabovethecountylevelandtheirexit/entryadministrationsshallberesponsiblefortheadministrationofthestayandresidenceOfforeigners.TheMinistryofPublicSecurityandtheMinistryofForeignAffairsmay,withinthescopeofth

9、eirrespectiveresponsibilities,entrustexit/entryadministrationsofpublicsecurityorgansorforeignaffairsdepartmentsunderlocalpeople*sgovernmentsatorabovethecountyleveltoacceptforeigners*applicationsforentry,stayandresidenceinChina.Intheadministrationofexit/entryaffairs,theMinistryofPublicSecurityandtheM

10、inistryofForeignAffairsshallstrengthencommunicationandcooperation,cooperatecloselywithrelevantdepartmentsundertheStateCouncil,andexercisefunctionsandpowersandbearliabilitieswithinthescopeoftheirrespectiveresponsibilitiesinaccordancewiththelaw.Article 5 TheStateshallestablishauniformexit/entryadminis

11、trationinformationplatformtoshareinformationamongrelevantadministrativedepartments.Article 6 TheStateshallestablishexit/entryborderinspectionauthoritiesattheportsopentoforeigncountries.Chinesecitizens,foreignersaswellastransportvehiclesshallexitorenterChinaviatheportsopentoforeigncountries,orviathep

12、lacesapprovedbytheStateCouncilorbythedepartmentsauthorizedbytheStateCouncilunderspecialcircumstances.PersonnelandtransportvehiclesthatexitorenterChinashallbesubjecttoexit/entryborderinspection.Exit/entryborderinspectionauthoritiesshallberesponsibleforrelevantadministrationworkintherestrictedzonesofp

13、orts.Onthebasisoftheneedforsafeguardingnationalsecurityandmaintainingtheorderofexit/entryadministration,exit/entryborderinspectionauthoritiesmayconductborderinspectiononthebelongingsofthepersonswhoexitorenterChina.Whennecessary,exit/entryborderinspectionauthoritiesmayconductborderinspectiononthegood

14、scarriedbytransportvehiclesthatexitorenterChina.Howeverexit/entryborderinspectionauthoritiesshallnotifytheCustomsofsuchinspections.Article 7 UponapprovalbytheStateCouncil,theMinistryofPublicSecurityandtheMinistryofForeignAffairsmay,onthebasisoftheneedforexit/entryadministration,setforthregulationson

15、thecollectionandkeepoffingerprintsandotherbiometricidentificationinformationofthepersonswhoexitorenterChina.WhereforeigngovernmentshavespecialregulationsonissuingvisastoChinesecitizensortheexit/entryadministrationofChinesecitizens,theChinesegovernmentmay,asthecircumstancesrequire,takecorrespondingan

16、dequivalentmeasures.Article 8 Departmentsandinstitutionsthatareresponsiblefortheexit/entryadministrationshalltakepracticalmeasures,constantlyimproveserviceandadministration,enforcelawsimpartially,provideconvenientandefficientserviceandensurethesecurityandconveyanceoftheexit/entryprocedures.ChapterII

17、ExitandEntryofChineseCitizensArticle 9 ChinesecitizenswhoexitorenterChinashallrinaccordancewiththelaw,applyforpassportsorothertraveldocuments.Chinesecitizensboundforothercountriesorregionsshallobtainvisasorotherentrypermitsfromdestinationcountries,unlesstheChinesegovernmenthassignedvisaexemptionagre

18、ementswiththegovernmentsofthosecountries,orotherwisestipulatedbytheMinistryofPublicSecurityandtheMinistryofForeignAffairs.ChinesecitizenswhoexitorenterChinaasseamenorworkonforeignshipsshallapplyforseamen,scertificatesinaccordancewiththelaw.Article 10 ChinesecitizenswhotravelbetweentheMainlandandtheH

19、ongKongSpecialAdministrativeRegion,betweentheMainlandandtheMacaoSpecialAdministrativeRegion,andbetweentheMainlandandTaiwanRegion,shallapplyforexit/entrypermitsinaccordancewiththelaw,andabidebytherelevantprovisionsofthisLaw.ThespecificadministrativemeasuresshallbestipulatedbytheStateCouncil.Article 1

20、1 ChinesecitizenswhoexitorenterChinashallsubmittheirexit/entrydocumentssuchaspassportsorothertraveldocumentstotheexit/entryborderinspectionauthoritiesforexamination,gothroughtheprescribedformalities,andmayexitorenteruponexaminationandapproval.Forportsthatmeetrelevantconditions,exit/entryborderinspec

21、tionauthoritiesshallprovideconveniencesuchasspeciallanesfortheexitandentryofChinesecitizens.Article 12 Underanyofthefollowingcircumstances,ChinesecitizensarenotallowedtoexitChina:(1) Holdnovalidexit/entrydocuments,orrefuseorevadeborderinspection;(2) Aresentencedtocriminalpunishments,theexecutionofwh

22、ichhavenotbeencompleted,oraresuspectsordefendantsincriminalcases;(3) AreinvolvedinunsettledcivilcasesandnotallowedtoexitChinaupondecisionofthepeople*scourts;(4) Aresubjecttocriminalpunishmentforimpairingborderadministration,orarerepatriatedbyothercountriesorregionsduetoillegalexitfromChina,illegalre

23、sidenceorillegalemployment,andtheNo-Exit-from-Chinaperiodhasnotexpired;(5) Mayendangernationalsecurityorinterests,andarenotallowedtoexitChinaupondecisionbycompetentdepartmentsundertheStateCouncil;or(6) OthercircumstancesinwhichexitfromChinaisnotallowedinaccordancewithlawsoradministrativeregulations.

24、Article13ChinesecitizensresidingabroadwhodesiretoreturntoChinaforpermanentresidenceshall,priortotheentry,fileapplicationswithChineseembassiesorconsulatesorotherinstitutionsstationedabroadentrustedbytheMinistryofForeignAffairs.TheymayalsofilesuchapplicationstotheoverseasChineseaffairsdepartmentsunder

25、thelocalpeople/sgovernmentsatorabovethecountyleveloftheproposedplacesofpermanentresidenceontheirownorviatheirrelativesinChina.Article14Whenhandlingfinancialaffairsoraffairsinvolvingeducation,medicaltreatment,transportation,telecommunications,socialinsuranceorpropertyregistration,whereidentitycertifi

26、catesarerequired,Chinesecitizensresidingabroadmayprovidetheirpassportsforproofofidentity.ChapterIIIEntryandExitofForeignersSection1VisaArticle 15 InordertoenteringChina,foreignersshallapplytothevisa-issuingauthoritiesstationedabroadforavisa,exceptasotherwiseprovidedforinthisLaw.Article 16 Visasareca

27、tegorizedasdiplomaticvisa,courtesyvisa,officialvisaandordinaryvisa.DiplomaticorofficialvisasshallbeissuedtoforeignerswhoenterChinafordiplomaticorofficialreasons;andcourtesyvisasshallbeissuedtoforeignerswhoaregivencourtesyduetotheirspecialstatus.Thescopeandmeasuresforissuingdiplomatic,courtesyandoffi

28、cialvisasshallbestipulatedbytheMinistryofForeignAffairs.AppropriatetypesofordinaryvisashallbeissuedtoforeignerswhoenterChinaduetonon-diplomaticorofficialreasonsincludingwork,study,familyvisit,travel,businessactivitiesandtalentintroduction.Thetypesofordinaryvisaandrelevantissuancemeasuresshallbestipu

29、latedbytheStateCouncil.Article 17 Theregistereditemsofavisashallincludevisatype,name,sex,dateofbirth,numberofallowedentries,validityperiodofentryanddurationofstayoftheholder;dateandplaceofissuance,aswellaspassportnumberorotherinternationaltraveldocumentsnumber.Article 18 Foreignerswhoapplyforvisassh

30、allsubmittheirpassportsorotherinternationaltraveldocuments,aswellasinformationofspecificapplicationmatters,tothevisa-issuingauthoritiesstationedabroad.Theyshallgothroughrelevantformalitiesandacceptinterviewsinaccordancewiththerequirementsofthevisa-issuingauthoritiesstationedabroad.Article 19 Wherefo

31、reignersapplyingforvisasneedtoprovidewritteninvitationsissuedbyentitiesorindividualswithinChina,theapplicantsshallprovidesuchinvitationsinaccordancewiththerequirementsofthevisa-issuingauthoritiesabroad.Entitiesorindividualsthatissuewritteninvitationsshallbeliableforthefidelityofthecontents.Article 2

32、0 ForeignerswhoneedtoenterChinaurgentlyforhumanitarianreasons,orareinvitedtoenterChinaforurgentbusinessorrushrepairwork,orhaveotherurgentneeds,andholdmaterialsthatprovethecompetentdepartments,approvaloftheirapplyingforvisasatport,mayapplyforportvisaswiththevisa-issuingauthoritiesentrustedbytheMinist

33、ryofPublicSecurityattheports(hereinafterreferredtoas,portvisaauthorities*)whichareapprovedtoissueportvisasbytheStateCouncil.TravelagenciesthatorganizeinboundtourisminaccordancewithrelevantStateregulationsmayapplyforgrouptouristvisasfromportvisaauthorities.Foreignerswhoapplytoportvisaauthoritiesforvi

34、sasshallsubmittheirpassportsorotherinternationaltraveldocuments,aswellasrelevantinformationofspecificapplicationmatters.Theyshallgothroughrelevantformalitiesinaccordancewiththerequirementsoftheportvisaauthorities,andenterChinaattheportswheretheyapplyforvisas.Visasissuedbyportvisaauthoritiesshallbesi

35、ngleentryandthedurationofstayshallnotexceed30days.Article 21 Underanyofthefollowingcircumstances,visasshallnotbeissuedtoforeigners:(1) Wasdeported,orwasrepatriatedupondecision,andtheNo-Entry-into-Chinaperiodhasnotexpired;(2) Issufferingfromseriousmentaldisorders,infectioustuberculosisorotherinfectio

36、usdiseasesthatmaySeverelyjeopardizethepublichealth;(3) MayendangerChina,snationalsecurityorinterests,ordisruptsocialandpublicorder;orengageinotherillegalorcriminalactivities;(4) ResorttofraudulentactsinvisaapplicationorcannotguaranteeexpectedexpendituresduringtheirstayinChina;(5) Failtosubmitrelevan

37、tinformationrequiredbythevisa-issuingauthorities;or(6) Othercircumstancesinwhichvisaauthoritiesconsideravisashouldnotbeissued.Thevisa-issuingauthoritiesarenotrequiredtogivereasonsforrefusingtheissuanceofavisa.Article 22 Underanyofthefollowingcircumstances,foreignersmaybeexemptfromapplyingforvisas:(1

38、) SoexemptedbasedonthevisaexemptionagreementssignedbytheChinesegovernmentwiththegovernmentsofothercountries;(2) Holdvalidforeigners*residencepermits;(3) Holdconnectedpassengerticketsandareintransittoathirdcountryorregionbyaninternationalaircraft,shiportrainviaChina,willstayfornotmorethan24hoursinChi

39、nawithoutleavingtheportofentry,orwillstayinthespecificzonesapprovedbytheStateCouncilwithintheprescribedtimelimit;or(4) OthercircumstancesstipulatedbytheStateCouncilinwhichvisasmaybeexempted.Article 23 WhereforeignersunderanyofthefollowingcircumstancesneedtoenterChinatemporarily,theyshallapplytoexit/

40、entryborderinspectionagenciesforgoingthroughtheformalitiesfortemporaryentry:(1) Foreignseamenandtheiraccompanyingfamilymembersdisembarkatcitieswheretheportsarelocated;(2) PersonsspecifiedinSubparagraph(3)ofArticle22ofthisLawneedtoleaveports;or(3) ForeignersneedtoenterChinatemporarilyduetoforcemajeur

41、eorforanyotherurgentreason.Thedurationofstayfortemporaryentryshallnotexceed15days.Forforeignerswhoapplyforgoingthroughtheformalitiesfortemporaryentry,exit/entryborderinspectionauthoritiesmayrequiresuchforeigners,thepersonsinchargeofthetransportvehiclesusedforsuchforeigners,entryortheagencieshandling

42、theexit/entrybusinessfortransportvehiclestoprovidenecessaryguarantymeasures.Section2EntryandExitArticle 24 ForeignerswhoenterChinashallsubmittheirpassports,otherinternationaltraveldocuments,visasorotherentrypermitstotheexit/entryborderinspectionauthoritiesforexamination,gothroughtheprescribedformali

43、ties,andmayenteruponexaminationandapproval.Article 25 Underanyofthefollowingcircumstances,foreignersshallnotbeallowedtoenterChina:(1) Holdnovalideitentrydocuments,orrefuseorevadeborderinspection;(2) AreinvolvedinanyofthecircumstancesspecifiedinSubparagraph(1)through(4)ofthefirstparagraphofArticle21o

44、fthisLaw;(3) MayengageinactivitiesnotconformtothetypesofvisaafterenteringChina;or(4) Othercircumstancesinwhichentryisnotallowedinaccordancewithlawsoradministrativeregulations.Exit/entryborderinspectionauthoritiesarenotrequiredtogivereasonsfordenyinganentry.Article 26 Exit/entryborderinspectionauthor

45、itiesshallorderforeignerswhoaredeniedentryinChinatoreturn,andshallforcethereturnofthosewhorefusetodoso.Whilewaitingforreturn,thoseforeignersshallnotleavetherestrictedzones.Article 27 ForeignerswhoexitChinashallsubmittheirexit/entrydocumentsincludingpassportsorotherinternationaltraveldocumentstotheex

46、it/entryborderinspectionauthoritiesforexamination,gothroughprescribedformalities,andmayexituponexaminationandapproval.Article 28 Underanyofthefollowingcircumstances,foreignersshallnotbeallowedtoexitChina:(1) Aresentencedtocriminalpunishments,theexecutionofwhicharenotcompleted,orsuspectsordefendantsi

47、ncriminalcases,exceptthosewhoaresentencedandtransferredunderrelevantagreementsbetweenChinaandforeigncountries;(2) AreinvolvedinunsettledcivilcasesandarenotallowedtoexitChinaupondecisionofthepeople*scourts;(3) Areinarrearsofpayingofflaborremunerationandthereforearenotallowedtoexitbydecisionoftherelev

48、antdepartmentsundertheStateCouncilorofthepeople,sgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment;or(4) Othercircumstancesinwhichexitshallnotbeallowedinaccordancewithlawsoradministrativeregulations.ChapterIVStayandResidenceofForeignersSection1StayandResidence

49、Article29Wherethedurationofstayspecifiedinavisaheldbyaforeignerdoesnotexceed180days,theholdermaystayinChinawithinthedurationspecifiedtherein.Wherethedurationofstayneedstobeextended,thevisaholdershallfileanapplicationwiththeexit/entryadministrationofpublicsecurityorganunderthelocalpeople*sgovernmentatorabovethecountylevelintheplaceofhisstaysevendayspriortoth
